New Delhi, Oct. 5 -- The Election Commission on Monday termed Congress leader Rahul Gandhi's claim that Chief Election Commissioner Gyanesh Kumar had "illegally and unilaterally" changed Form 6 as misleading, while the Supreme Court clarified that it had not approved any modification to the voter enrolment form.

Gandhi, in a post on X, alleged that Kumar had altered Form 6 to benefit the BJP and said those involved would be held accountable. Responding with a fact check, the EC said the Special Intensive Revision (SIR) order for Bihar was issued on June 24, 2025, with the unanimous approval of the Commission.

The poll panel said the order was upheld by the Supreme Court in its May 27, 2026 judgment. It also referred to its September 25 press note, which stated that the declaration attached to Form 6 for the SIR had been upheld by the court.

The EC later withdrew from its online portals in non-SIR states the declaration seeking parents' details from applicants seeking enrolment.

Form 6 is used by people applying for inclusion in electoral rolls. The online form and the attached declaration had a single OTP process for both documents, rather than separate OTPs, leading to questions over whether the declaration formed part of Form 6.

On Monday, however, a bench headed by Chief Justice Surya Kant said the court had not approved any changes to Form 6. "Any modification to Form 6 has not been approved by us. Let's be clear," the bench said, adding that it would examine records to determine who had made any modification.

The EC also rejected claims that it had removed its September 26 press note from its website, sharing its link to show that it remained available.
