SC cancels bail to Anant Singh
New Delhi, Oct. 31 -- The Supreme Court on Friday cancelled the bail granted to expelled Janata Dal (United) legislator Anant Singh and directed him to surrender by December 1, marking a significant twist in the ongoing murder case of Jan Suraaj Party leader Dularchand Yadav last year.
The top court's decision comes as Singh has lost favour with the JD(U) leadership which expelled the Mokama MLA along with his wife Neelam Devi for alleged "anti-party" activities. The court directed the state government to complete the investigation against Singh within four months.
A bench of justices MM Sundresh and PB Varale passed the order on a petition filed by Yadav's grandson Niraj Kumar challenging the Patna HC order of March 19 granting bail.
The petitioner informed the court that the high court granted bail citing political rivalry while overlooking the fact that he was accused in 67 criminal cases. Yadav, aged 75, was campaigning for Singh's rival candidate in Mokama during the Bihar assembly elections last year when the killing took place. Advocate Shilpi Chowdhary appearing for the deceased's grandson, pointed out that Yadav was unarmed and had not provoked the accused. The accused allegedly shot a bullet at Yadav and he was run over by a car leading to his death.
The bench asked the accused represented by senior advocate Siddharth Dave to explain why the bail granted should not be cancelled. The incident took place on October 30, 2025 and he was arrested on November 1. He remained in custody till the order granting bail.
Dave informed the court that the petition stated wrong facts as there are only 13 pending cases against him of which only two involve heinous offences of murder and attempt to murder. He further told the court that the other accused are already out on bail and contradicted the prosecution story that the deceased was run over by Singh's vehicle. He pointed out to eyewitness accounts which revealed that the incident took place after Singh's vehicle had passed. the
The bench said that this is a matter of trial while terming the facts as "serious" and "disturbing". It asked the state to specify the time period by when the investigation will be over as the petitioner apprehended that the accused, while on bail, could influence the probe.
Advocate Naveen Kumar appearing for Bihar government said that the crime is serious and the accused carries a "massive criminal history" comprising 62 recorded criminal cases involving grave offenses such as murder, attempt to murder, kidnapping, extortion, offenses under the Arms Act and Explosive Substances Act.
Following the grant of bail, state had received a complaint by the present petitioner of having received a death threat. Even unidentified anti-social elements were maintaining constant vigil outside his house.
As the court was inclined to cancel the bail order, Dave requested for time to surrender citing a marriage in Singh's family. While the state sought time to take instructions for completion of the probe, the bench set an outer limit of four months for the investigation to conclude....
