MUMBAI, Sept. 13 -- The Bombay High Court on Friday quashed three related FIRs, including one registered against the son of a city builder and the fiance of his sister, for allegedly kicking a pregnant woman in lift, leading to a miscarriage. The court also ordered their immediate release from jail. The court struck down the FIRs because of the amicable settlement between the parties. Justice Milind Jadhav said the incident happened on the spur of the moment and the parties wished to move on; therefore, a "quietus and closure" was required. The incident took place at 2:30am on November 15, 2025, when the complainant, Amrina Fernandes, was assaulted inside a lift at her workplace by accused Tanay Jitendra Shah, his sister Yashvi Shah, and her fiance Rhythm Arvind Goyal. According to the FIR, a verbal spat ensued when Goyal pointed a laser light at Amrina. When she objected and tried to snatch the laser gun, he hit her with it. Amid the scuffle, Goyal and Shah assaulted the woman in the stomach and pushed her to the ground. When the liftman tried to intervene, he was also assaulted. Amrina's colleagues took her to a hospital where she was examined and informed that she had suffered a miscarriage. On November 19, the Amboli police registered an FIR against Goyal and Shah under sections 74, 79, 89, 118(1), 3(5) of the Bharatiya Nyaya Sanhita (BNS). Chief public prosecutor Shishir Hiray and additional public prosecutor Yogesh Nakhwa opposed the petitions filed by Goyal and Shah, pointing out that the offence was against society at large, not just an individual, because the duo caused the death of an unborn child. Justice Jadhav, however, considered the woman's wishes, noting that the assault on her was not premeditated and pointing out the inconvenience caused to her because of the litigation. "The long lasting effects of a criminal prosecution can be traumatic for any complainant in a given case especially when she is a woman," said the judge, adding that the complainant's genuine desire prompted him to quash the FIRs.
