MUMBAI, July 2 -- The Bombay High Court on Tuesday declared the arrest of a prominent Mumbai builder, accused of repeatedly raping a relative after allegedly blackmailing her with intimate photographs taken while she was intoxicated during a family trip abroad, illegal and ordered his immediate release.
Justice Shyam C Chandak held that the arrest violated constitutional safeguards because the police failed to furnish the builder with the grounds of arrest before taking him into custody. The court quashed successive magistrate orders extending his remand.
According to the prosecution, Tardeo police registered an FIR on May 21, 2026, after the woman alleged that during a family trip to London in August 2024, the builder filmed her while she was under the influence of alcohol, used the images to blackmail her into a sexual relationship, and repeatedly assaulted her. She further alleged that he later demanded Rs.50 lakh, prompting her to approach police.
Senior advocate Abad Ponda argued that the builder's arrest was illegal because no grounds were communicated before detention. The court ordered the builder's release from jail with immediate effect on Tuesday. htc...
