New Delhi, Oct. 10 -- The Supreme Court on Friday issued notices to three accused in sexual offence cases decided by the Allahabad, Jharkhand and Calcutta high courts, flagging insensitive language used in the judgments and stressing the need to sensitise judges.
A bench headed by Chief Justice of India Surya Kant said it was "very shocking" that the Allahabad high court had observed in a March 2025 judgment that a woman "herself invited trouble and was also responsible for the same".
The proceedings follow the Supreme Court's decision last month to take suo motu cognisance of a Patna high court judgment that said pressing a woman's chest and removing her salwar did not amount to attempted rape.
The bench, also comprising justices Joymalya Bagchi and V Mohana, said the National Judicial Academy had prepared a handbook on judicial language. Senior advocate Shobha Gupta, representing We The Women of India, cited the three judgments, arguing that insensitive remarks undermine victims' trust in courts....
