LUCKNOW, June 20 -- The Lucknow bench of the Allahabad high court on Friday stayed the orders for the repatriation of primary schools' teachers (returning them to the same schools from which they were transferred last year) until further orders by the court in the matter. The court gave the respondents - the state government and basic education department officials - three weeks to file their reply affidavits. Following this, the petitioning teachers will be able to submit a rejoinder affidavit (counter-reply) within a week. A vacation single bench of Justice Arun Kumar Singh Deshwal passed this order on June 19 on a petition filed by 10 primary teachers, including Amit Kumar of Gautam Buddha Nagar district. The petition challenged the orders of the district basic education officer of Gautam Buddha Nagar, dated April 25 and May 16 this year, as well as the orders of the block education officer. These orders repatriated the petitioner teachers to their previous postings. The petitioners' counsel stated that on June 16, 2025, the basic education department implemented a policy for inter-district transfers of assistant teachers. Under this policy, the petitioner teachers were relieved from their schools and transferred to their new postings, where they had been employed for over 10 months and drawing salaries. Despite this, they were repatriated. Meanwhile, the basic education council's lawyer opposed the petition. The court stated that the district basic education officer misinterpreted the two orders issued in July and August 2025, and therefore, the matter requires consideration.
