Lucknow, May 14 -- The Lucknow bench of the Allahabad high court has ruled that regularisation of an employee is implicit in confirmation. Once an employee's services are confirmed, and the confirmation is not challenged on grounds of illegality, the same attains finality, it said. With this ruling in a service matter, the high court has directed the respondents - revenue authorities - to consider case of the petitioner for promotion to the post of assistant consolidation officer (ACO) with effect from the date his juniors were promoted, along with all consequential benefits, including seniority, within a period of three months. Justice Karunesh Singh Pawar passed the judgment on May 11 while allowing a petition moved by Deva Nand Srivastava, seeking directives to consider and promote him to the post of assistant consolidation officer with effect from the date on which his juniors were promoted, along with all consequential benefits, including seniority, within such reasonable time as may be fixed by the court. The petitioner's counsel Abhineet Jaiswal submitted that the petitioner's services on the posts of consolidation lekhpal as well as consolidator were duly confirmed. Therefore, the ground taken in the impugned rejection order, to the effect that the petitioner was appointed on an officiating basis and his services were not regularised, was not sustainable in the eyes of law. On the other hand, the state counsel opposed the plea. The court said the impugned order was wholly untenable and liable to be set aside. "Accordingly, the writ petition succeeds and is allowed," the court ordered. It also quashed the impugned order dated October 9, 2025, through which the promotion of petitioner to the post of ACO was denied. The court further directed the respondents to consider the petitioner's case for promotion to the post of ACO with effect from the date his juniors were promoted, along with all consequential benefits, including seniority, within three months from the date of production of a certified copy of this order.
