Promoters charging illegal transfer fee on RERA's scanner
LUCKNOW, May 9 -- The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has launched an online complaint mechanism on its portal against promoters and developers charging illegal transfer fees.
Allottees can now file grievances through Form-M on the official UP RERA portal. The move follows the 10th Amendment to the UP RERA General Regulations, 2019, which caps the maximum transfer and processing fees promoters can charge for allotment transfer or succession.
Under amended Regulation 47(C), promoters cannot execute a new or amended sale/lease agreement with successors. Only necessary endorsement will be made in the existing agreement and records will be updated.
Real estate stakeholders have welcomed the move, saying it will strengthen compliance with the Real Estate (Regulation & Development) Act and better protect homebuyer interests in the state.
Successor must submit the allottee's original death certificate, succession certificate from competent authority, and NOC from other surviving legal heirs. Maximum Rs 1,000 processing fee for transfer to another family member, while for transferring to non-family member the maximum processing fee will be Rs 25,000.
