PRAYAGRAJ, July 30 -- The Allahabad High Court on Tuesday dismissed a Public Interest Litigation (PIL) seeking enforcement of a 2008 Full Court resolution on court sitting hours, holding that a writ of mandamus cannot be issued against High Court judges and observing that the plea was based on incomplete facts. A bench comprising Chief Justice Arun Bhansali and Justice Kshitij Shailendra dismissed the PIL filed by practising advocate Arun Mishra, who alleged that several courts did not begin proceedings on time on May 5, 2026, despite being listed to function that day. The petition sought implementation of the Full Court resolution dated August 27, 2008, which prescribes court sitting hours at the Allahabad bench from 10 am to 1 pm and 2 pm to 4 pm, with a lunch break from 1 pm to 2 pm. According to the petitioner, only a limited number of courts began proceedings at 10:05 am on May 5, while several others commenced at 10:10 am, 10:15 am and 10:20 am. The petition also sought directions that information regarding delayed court sittings be displayed on notice boards and reflected in the cause list to inform advocates and litigants in advance. Rejecting the plea, the court observed that the petitioner had failed to provide complete facts. "The nature of relief, which has been sought in the petition, is based on incomplete facts as the petitioner has not cared to indicate as to how many Courts on that particular day sat beyond the time fixed and continued to discharge the judicial work," the bench observed. In its July 28 order, the court further held that "seeking a mandamus, which essentially is directed against the Judges of this Court, cannot be countenanced."...
