HC bars large gatherings at house, drops contempt notices against DM & SSP
PRAYAGRAJ, April 2 -- The Allahabad high court has directed a man, who was earlier granted security after allegedly being stopped from offering namaz at his house, not to hold large gatherings.
The petitioner also gave an undertaking that he would not allow a large number of people to assemble at his property for offering namaz.
The court asked the state authorities to take action if public peace and tranquillity are threatened due to large gatherings. The high court also discharged the contempt notice issued to the Bareilly district magistrate and senior superintendent of police.
In an order dated March 25, a division bench comprising Justice Saral Srivastava and Justice Garima Prashad also directed the immediate withdrawal of security provided to Haseen Khan after the state counsel submitted that he no longer required it.
In compliance with an earlier order, the Bareilly district magistrate and senior superintendent of police appeared before the court on March 25 and filed personal affidavits.
Appearing for the state, additional advocate general (AAG) Anoop Trivedi submitted that the petitioner was misusing the security cover and that around 50-60 people were offering namaz at his property everyday. To support the claim, the state placed photographs of the premises on record along with the affidavits.
The AAG argued that allowing such gatherings could be detrimental to peace and tranquillity in the area and that the state would be compelled to act in case of any law and order concerns.
Taking into account these submissions, the court took on record the undertaking of the counsel for the petitioner that he would not allow large gatherings for namaz at his property in question.
Accepting this stance, the division bench observed, "We hope and trust that the petitioner shall abide by the undertaking given by him. In case, the petitioner violates the aforesaid undertaking and collects in large numbers to offer Namaz at the property, which is subject matter in the present writ petition and if there is threat to peace and tranquility in the area, the respondent authorities are at liberty to act in accordance with law."
The court also directed the state authorities to immediately withdraw a police challan dated January 16, 2026, issued against the petitioner and others. The high court disposed of the writ petition filed by Tarik Khan, a resident of Bareilly....
