HC again directs Centre to produce case file
Lucknow, March 27 -- The Lucknow bench of the Allahabad high court on Thursday again directed the Central government to produce before the court the case file related to the alleged dual citizenship controversy involving Congress leader and Rae Bareli MP Rahul Gandhi.
As the case has been transferred to the court of justice Subhash Vidyarthi, the court heard the criminal application case under section 528 BNSS, seeking registration of an FIR against Rahul Gandhi on the issue of alleged dual citizenship.
The court also allowed petitioner Vignesh Shishir's application to implead secretary, ministry of home affairs, government of India, as respondent in this case.
Hearing the case, justice Subhash Vidyarthi directed the ministry of home affairs of the Union government to produce all original documents related to Rahul Gandhi's alleged dual citizenship issue before the court on the next date of hearing, on April 6.
During the hearing of the case, Union government counsel advocate Varun Pandey, who represented the ministry of home affairs, requested that the next hearing be held in the judge's chamber as secret files will be produced. The court accepted the request.
The court also directed the state government to file an affidavit on the issue.
On petitioner's request to personally inspect the case file related to Rahul Gandhi, the court pointed out that it will be decided after files are produced.
The petitioner challenged the January 28, 2026, order passed by the Special MP-MLA Court, Lucknow. In that order, the court rejected the demand to register an FIR against Rahul Gandhi. The special court had stated that it did not have jurisdiction to decide on the issue of citizenship.
The petitioner has levelled charges against Rahul Gandhi under the Indian Penal Code, the Official Secrets Act, the Foreigners Act, and the Passport Act.
The complaint was initially filed in the Special MP/MLA Court in Rae Bareli. Later, on the complainant's application, the Lucknow bench of the high court transferred the case from Rae Bareli to Lucknow on December 17, 2025.
The Lucknow Special Court dismissed the petition on January 28, 2025.
