Alld high court flags prolonged vacancies in child rights panel
Lucknow, June 5 -- Expressing concern over Uttar Pradesh State Commission for Protection of Child Rights (UPSCPCR) working without chairman and members for a prolonged period, the Lucknow bench of the Allahabad High Court has directed the sate government to complete the appointment process for the chairperson and members of the Commission 'on a war footing'.
A division bench of Justices Justices Shekhar B. Saraf and Abdhesh Kumar Chaudhary passed the order on June 2 on a PIL filed by the Human Unity Movement.
" Upon considering the prayers of the petitioner and after hearing learned counsel for the parties, we direct the State Government to look into this aspect on a war footing and appoint Members and Chairman expeditiously, preferably within a period of four months from date," said the court.
In the petition, it was pointed out that the tenure of the Uttar Pradesh State Commission for Protection of Child Rights ended on November 16, 2024, and since then the posts of chairperson and members have remained vacant, rendering the Commission completely non-functional.
The petitioner argued that the Commission is a statutory body entrusted with vital responsibilities such as protection of child rights, monitoring cases of child labour and child trafficking, oversight of POCSO Act implementation, inspection of child care institutions, and monitoring the implementation of the Right to Education Act.
Considering the seriousness of the matter, the Court directed the state government to immediately address the issue and expedite the process of appointing the Chairperson and Members of the Commission....
