HC tells govt to set up 'modern' forensic labs citing lack of infra
JODHPUR, May 30 -- The Rajasthan High Court on Thursday directed the state government to establish modern and well-equipped investigation laboratories across the state, observing that the current lack of forensic infrastructure is causing unnecessary delays in criminal investigations and violating the right to fair investigation and speedy trial.
A single bench of Justice Anoop Kumar Dhand issued the directions while hearing two criminal miscellaneous petitions. The court noted that the state police department is currently compelled to rely on reports from labs situated in other states, leading to significant delays.
The bench said: "In the considered opinion of this Court, when the entire system and society are moving at a fast pace in the current era, and criminals are also adopting the latest and advanced techniques to commit offences, then under such circumstances, the investigation mechanism of the police is also required to be strengthened with modern and well-equipped investigation labs having adequate scientific facilities. Investigation labs are not available in the state and, therefore, the State Police Department is compelled to conduct its investigation based on the reports and analysis carried out by investigation labs situated in other states, which causes unnecessary delay in investigation, and the culprits often get benefit from delay."
It added: "Looking at the increase in the rate of crime, the existing FSL in the state is not sufficient. The time has now come to strengthen and expand the cadre strength of investigators and staff so that FSL reports can be received at the earliest and the investigation report can be submitted before the court expeditiously and in a time-bound manner.
The court said that time has now come to modernise and strengthen the police investigation wings from all corners. Latest investigation labs are required to be established with adequate infrastructure and trained personnel, so that investigations can be completed expeditiously. The bench directed that copies of the order be sent to the Chief Secretary, the Additional Chief Secretary of the Home Department, and the Director General of Police, asking them to examine the matter....
