hc junks pleas against show cause notices to border shrines
JODHPUR, July 14 -- The Rajasthan High Court on Monday dismissed a batch of writ petitions challenging show-cause and eviction-related notices to madrasas, mosques, dargahs and other religious structures located within 50 kilometres of the international border with Pakistan, holding that they were not maintainable and that the petitioners had adequate statutory remedies under relevant laws.
The court also directed that district-level committees comprising the district collector, superintendent of police and a representative of the Border Security Force (BSF) be formed to examine such cases individually.
Justice Sameer Jain observed that the pleas, which challenged notices issued under the Rajasthan Colonization Act, 1954, the Rajasthan Land Revenue Act, 1956 and other statutory provisions concerning properties in the border belt, suffered from inherent deficiencies, particularly with regard to identity of the petitioners, and absence of cogent material establishing their nexus with the concerned strictures. It ;asp noted that in several cases, the petitioners admitted that no permission was obtained under Sections 5 and 6 of the Rajasthan Religious Buildings and Places Act, 1954, making the structures unauthorised.
