can't spend public money on cases caused by greed of complainant: HC
JODHPUR, July 7 -- The Rajasthan High Court has directed the Superintendent of Police, Dausa, to recover the cost of investigating a cyber fraud case from the complainant, observing that public money cannot be spent on investigating offences that, prima facie, occur because of the complainant's own greed.
The court said the complainant, a government teacher drawing a monthly salary of more than Rs.80,000, transferred nearly Rs.20 lakh to the accused in the hope of receiving higher returns. It directed that the recovered amount be deposited in the Rajasthan Police Welfare Fund.
The order came while dismissing the bail applications of two accused in the case.
Justice Ravi Chirania made strong observations on the role of greed in cyber frauds. "The incident happened because of the greed of the complainant, who is a Government Teacher, receiving salary of more than Rs.80,000/- per month. He, against his policy of Rs.2,47,000/-, went into the trap of greed and transferred money on various occasions to the accused-petitioners amounting to Rs.20,00,000/- because he was getting increased amount after every transaction which sufficiently shows his uncontrolled greed" the bench noted.
The bench further observed: "The reason behind successful commission of most cyber crimes is the greed of people like the complainant herein, who, in expectation of earning unusual high returns/unclaimed money, etc., get trapped in such acts."...
