Chandigarh, Sept. 19 -- A fast track special court acquitted Appu alias Raju, who was accused of kidnapping a minor girl, wrongfully confining and raping her, holding that the prosecution failed to prove the charges beyond reasonable doubt. Additional sessions judge Yashika pronounced the judgment on September 9. According to the prosecution, the girl went missing from her residence on December 29, 2024, and was recovered on February 9, 2025. The prosecution alleged that the accused took her to Haryana, confined her in a rented accommodation and subjected her to repeated sexual assault. However, in her testimony, the girl stated that she had gone with the accused voluntarily after he proposed marriage to her. She said they travelled to Haryana and stayed together, and later solemnised their marriage at a temple in Devdasspur. The court also found doubts surrounding her age. While the prosecution relied on school records showing her date of birth as January 1, 2008, the school official admitted that the date had been recorded based on a transfer certificate and had not been independently verified. On the kidnapping charge, the court referred to the Supreme Court's ruling in S Varadarajan vs state of Madras, observing that there is a distinction between "taking" a minor and allowing or accompanying a minor who voluntarily leaves her guardian.htc...
