Chandigarh, Aug. 22 -- The Central Administrative Tribunal (CAT), Chandigarh bench, has directed Government Medical College and Hospital (GMCH), Sector 32, to allow its registrar (academics) Sat Pal Singh to continue working on the post on the same terms and conditions as his existing contractual appointment, till the authorities decide his pending request for extension. A division bench comprising member (judicial) Ramesh Singh Thakur and member (administrative) Anjali Bhawra passed the order on Friday in an application filed by Singh, who had challenged the denial of further extension of his contractual engagement. Singh had earlier served as registrar (academics) on deputation and continued in the post till his superannuation on November 30, 2020. He was subsequently selected and re-engaged on a contractual basis from December 23, 2020, under the Chandigarh administration's policy for engagement of retired government employees. His contract was initially for six months and was extended periodically. He submitted a representation on September 18, 2023, seeking further extension. Singh contended that the request was not decided and that he was later orally informed that the post had been deemed abolished as it had not been filled on a regular basis for over two years. The authorities disputed this, stating that no official communication declaring the post abolished had been issued. They also said they intended to fill the post through the prescribed recruitment process. The tribunal noted that Singh's contractual engagement had been extended from time to time and that there were no adverse remarks against him. It also observed that the post had remained continuously occupied by him after his contractual engagement and had never remained vacant. The CAT directed the respondents to decide Singh's September 18, 2023 representation in accordance with his appointment terms and the Chandigarh administration's October 9, 2018 policy.
