Man gets life term for labourer's murder
Panchkula, Aug. 23 -- Observing that sentencing is an important task in criminal cases and that punishment must be appropriate, adequate, just and proportionate to the nature and gravity of the offence, the Panchkulasessions court awarded rigorous life imprisonment to a 32-year-old Parvesh Chaurasia for the murder of a 60-year-old man in Chandimandir in June 2020.
Sessions judge Sanjay Sandhir, while dealing with the prosecution's plea for a deterrent sentence and the defence's request for leniency, observed that there was no "straight jacket formula" for sentencing an accused after conviction.
The court said the twin objectives of sentencing policy were deterrence and correction, and the sentence required to meet the ends of justice depended on the facts and circumstances of each case.
Chaurasia was awarded rigorous life imprisonment and Rs.5,000 fine under Sections 302 (murder) of the Indian Penal Code and a year's rigorous imprisonment, along with Rs.1,000 fine under Section 201 (destruction of evidence) of the Indian Penal Code.
Both sentences will run concurrently.
The case pertains to the murder of 60-year-old Vishavnath, a labourer, in the Chandimandir area in June 2020. Vishavnath, a native of Gorakhpur in Uttar Pradesh, had been living in a tin shack for around 15 years.
His body was found in bushes along the Panchkula-Pinjore highway, near a petrol pump in Chandimandir. He had suffered fatal injuries to his head and his face was badly crushed.
According to the FIR, stone-crusher Munshi Uma Kant, who said he knew the victim, told the police that he had seen Chaurasia with Vishavnath a night before the murder.
Police investigation revealed that Chaurasia frequently visited Vishavnath and the two used to drink together.
On the fateful day, Kant had noticed blood scattered outside Vishavnath's shack and found that he was missing.
During a search, his body was found in the bushes around 50 ft away from the shack. Blood-stained stones were also recovered from the spot.
Chaurasia was a driver by profession. He had allegedly attacked the victim withrods.
On the basis of Kant's complaint, police registered a murder case against Chaurasia and arrested him on June 4, 2020. Chaurasia, originally from Sultanpur district of Uttar Pradesh, had remained in custody since his arrest....
