Hawara's Punjab jail transfer plea deferred after IB flags poll impact
New Delhi, Nov. 4 -- The Supreme Court on Tuesday deferred hearing on a plea by Babbar Khalsa terrorist Jagtar Singh Hawara, undergoing life imprisonment for the 1995 assassination of former chief minister Beant Singh, seeking transfer from Delhi's Tihar jail to a Punjab prison after inputs received from the Intelligence Bureau (IB) indicated that the move will have a "huge impact" on the upcoming assembly elections in the state. The matter will now be heard after February 2027.
Hawara sought to be shifted to Punjab, where his 90-year-old mother and family stay. The top court last month sought an IB view after the Delhi government, Punjab government and the Chandigarh administration expressed their reservations about accepting the demand.
The bench of justices MM Sundresh and PB Varale said, "Normally we would have no difficulty in considering this request. But what the agency has said is very damning."
The court said the note says it will have a huge impact on the ongoing elections, especially in the present scenario when the issues are alive here and abroad.
Senior advocate S Muralidhar, appearing for Hawara, said, "If the elections are the reason, the court may keep this back. This may be heard after three months." The bench posted the matter after February by when the elections in the state are expected to be over. In his petition, Hawara said his mother is of advanced age and sought parole to visit his family. Muralidhar told the court that he did not have access to the IB report but believes the jails in Punjab are as secure as Tihar, a point the Centre cannot object to.
The court had last month indicated that since reservations have been expressed by Punjab and Chandigarh administration, its order should not create any further problems. It was in this regard that the court allowed the Centre to take inputs from the IB.
On the previous date of hearing, Hawara's lawyers had argued that while committing the crime, he was a young man of 21 and since then he has realised the consequences of his action. The Centre had earlier submitted that Hawara is convicted in six cases and in January 2004, he was involved in a jailbreak incident by digging a tunnel while in Burail Jail in Chandigarh. He escaped and was subsequently arrested.
Punjab chief minister Bhagwant Mann had recently written to the state governor for granting a 10-day parole to Hawara on humanitarian grounds. However, the court weighed the "larger public interest" while dealing with this matter.
Hawara was convicted in the bomb blast case outside the civil secretariat in Chandigarh on August 31, 1995, which led to the death of the then CM and 16 others. He was initially sentenced to death by a Chandigarh court. In 2010, his capital punishment was commuted to life term by the high court, stating that he shall remain in jail for the remainder of his natural life....
