MUMBAI, Oct. 9 -- Bombay high court has held that Section 482(4) of Bharatiya Nagarik Suraksha Sanhita (BNSS) does not impose absolute bar on granting anticipatory bail to people accused of raping a girl below 16 years of age or gang-raping a girl. "Section 482(4) does not impose an absolute bar," said a bench of justice MM Nerlikar on Wednesday, adding, the prohibition applies only when prima facie case is made for offences punishable under Sections 65 (rape on a girl below 16 years of age) or 70(2) (gangrape on a minor girl) of BNS.
