NCLAT rejects DoT's Rs 469 crore appeal in Rolta insolvency case
India, Aug. 3 -- The National Company Law Appellate Tribunal (NCLAT) has reportedly dismissed the Department of Telecommunications' (DoT) appeal challenging the resolution plan of insolvent technology company Rolta India, ruling that the insolvency process has already reached finality and cannot be reopened after the plan has been implemented as per media reports.
The decision reinforces a key principle under India's Insolvency and Bankruptcy Code (IBC) that once a resolution plan has been approved by the adjudicating authority and implemented, it should not be disturbed on claims that were not raised in time.
