Today, Congressman Rich McCormick (GA-07) introduced the House companion to Senator Marsha Blackburn's Ban Birth Tourism Act of 2026. This legislation will close a loophole in U.S. immigration law by preventing foreign nationals from traveling to the United States for the primary purpose of giving birth. As a result, their child automatically acquires American citizenship.
The legislation follows the Supreme Court's recent decision in Trump v. Barbara. It amends the Immigration and Nationality Act to make birth tourism grounds for inadmissibility and deportation while providing immigration officials with the authority to stop the practice before it occur...
