Parmod KumarNew Delhi, July 27 -- Observing that there were enormous issues with the Constitution's Tenth Schedule dealing with the anti-defection law, the Supreme Court on Monday issued notice to the union Government on a plea by senior advocate Kapil Sibal questioning the interpretation of the constitutional provision.
The Court, however, observed that the Tenth Schedule was enacted by Members of Parliament themselves to regulate the functioning of legislators.
A Bench of Justice Pamidighantam Sri Narasimha and Justice Alok Aradhe made the observations while hearing Sibal's petition challenging the interpretation of the Tenth Schedule, particularly the merger provision under the anti-defection law.
