Srinagar, May 8 -- Srinagar- Underlining that no person can be allowed to retain a benefit which is not legally due to him, the High Court of J&K and Ladakh has upheld orders directing recovery of more than Rs 2.61 crore, along with 6 percent interest, from a landowner in an acquisition case related to the four-laning of the Srinagar-Jammu Highway at Sangam in Anantnag district.
A bench of Justice Wasim Sadiq Nargal dismissed a petition filed by the landowner, challenging orders passed by the Principal District Judge Anantnag, which had last month directed refund of excess compensation allegedly received twice under the same compensation stream.
