J&K HC Rejects Compensation Plea In Closed NDPS Case
Srinagar, July 22 -- Srinagar- The High Court of J&K and Ladakh has dismissed a petition seeking quashing of an FIR registered under the Narcotic Drugs and Psychotropic Substances (NDPS) Act and compensation of Rs 50 lakh each for four accused persons, holding that the police acted within the framework of law and that there was no material to establish mala fides or violation of fundamental rights.
A bench of Justice Shahzad Azeem observed that although the investigation had already been closed as "not admitted" for want of sufficient admissible evidence, the petitioners were not entitled to compensation merely because no charge sheet was filed.
