India, Sept. 22 -- The case returns to the magistrate after Sessions court faults earlier order for gaps in law and reasoning

A Delhi Sessions court on Monday set aside a magistrate's order refusing to probe the allegation that the name of Congress leader Sonia Gandhi was included in the electoral roll three years before she acquired Indian citizenship in 1983. A complaint filed by advocate Vikas Tripathi alleges Sonia Gandhi was an Italian citizen when her name appeared and she voted in the 1980 election. Special Judge Vishal Gogne was hearing a revision plea against the magisterial court's order on Tripathi's complaint, who is also the vice president of the Central Delhi Court Bar Association of the Rouse Avenue courts.
