Kolkata, Sept. 11 -- The Calcutta High Court has granted anticipatory bail to AJUP MLA Humayun Kabir in a case registered at Rejinagar Police Station, observing that custodial interrogation was not required and that the alleged offence under Section 152 of the BNS was not made out even prima facie.
The court passed the order on September 10 after examining the case diary and investigation materials. Kabir faces charges under several BNS provisions over remarks allegedly made at a public gathering.
The prosecution argued that Section 152 applied as Kabir had allegedly used threatening language against a political party and public servants.
It also opposed bail, citing his position as an elected representative and potential public-order concerns.
The court, however, noted his cooperation with the probe. Kabir had responded to two notices under the BNSS and was questioned for around four and five hours respectively.
The court also noted that the electronic clipping of the speech had been seized and no complaint or untoward incident followed the speech. It directed that Kabir be released on bail if arrested, subject to conditions.
