
New Delhi, Oct. 2 -- A Delhi court has acquitted two men accused of robbing and shooting a man at a metro station in 2018, observing that the prosecution failed to establish their identity as the assailants or scientifically link the recovered pistol to the firing.
Additional Sessions Judge Twinkle Wadhwa acquitted Deepak alias Golu and Shanu alias Furkan in the case registered at Karawal Nagar police station under provisions of the IPC and Arms Act.
According to the prosecution, Aas Mohd had gone to Jawahar Nagar Metro Station on April 27, 2018, when three boys allegedly tried to snatch his mobile phone. On resisting, one of them allegedly fired at him with a country-made pistol, injuring his right arm.
Police apprehended Deepak and Shanu the following day and claimed that Aas Mohd identified them. A country-made pistol was subsequently recovered at Shanu's instance.
However, Aas Mohd denied before the court that the two men were the assailants or that he had identified them earlier. The court noted that he was the only eyewitness and there was no CCTV footage or other eyewitness evidence to support the prosecution. The court also found the weapon recovery doubtful, noting that Aas Mohd denied witnessing it despite his signature appearing on the seizure memo. The court found the recovery unsupported and forensic evidence inconclusive, leaving the prosecution unable to establish the weapon's connection to the shooting. mpost
