Heard learned counsel appearing for both the parties.
Mr. D. Datta, learned counsel appearing for the petitioner submits before this before that he wants to withdraw this present petition with liberty to avail remedy as per law.

Accordingly, the instant writ petition is dismissed as withdrawn with liberty to avail remedy before the Civil Court in accordance with law.
