PATNA, Sept. 25 -- The Patna High Court has quashed an indefinite expulsion order issued by Mahatma Gandhi Central University (MGCU) against Akash Kumar, a PG 1st semester Media Studies student, ordering his immediate reinstatement and permission to sit for examinations. Kumar was suspended and subsequently expelled after using social media to expose alleged administrative irregularities in the promotion of a non-teaching staff member. Despite flagging the illegalities, no action was taken. The university expelled him from the University with immediate effect on account of serious indiscipline and recalcitrant disposition, and he was prohibited from entering into any of the university's campuses or premises, including all academic and administrative blocks, and also debarred from taking admission into any programme of study in the university. The student did not even get a copy of the inquiry report or a specific show-cause notice regarding expulsion. The order passed on September 21 was uploaded in Thursday. Coming down heavily on the university's arbitrary procedure, the bench of Justice Harish Kumar in its judgement observed that inflicting an unspecified ban destroys a student's future, calling the punishment "a civil death of the academic career of a student, and in no circumstances sustainable in law." Even before inflicting the extreme punishment of expulsion for an indefinite period, which prima facie appears to be not even authorised under the Act and the Ordinance, the petitioner has not been served with the specific show-cause notice along with the enquiry report... The action of the respondent-authorities, in the considered opinion of this Court, does not withstand the test of fairness, besides clearly violating the principle of natural justice," the bench said. Setting aside the OSD Administration's expulsion order dated August 14, 2024, the court directed the university authorities to immediately induct Kumar back into his programme, while noting that the student is expected to maintain discipline going forward....
