PATNA, Sept. 17 -- The Patna High Court has slammed the Nalanda administration, quashing its externment orders against two Nalanda residents under the Bihar Crime Control Act (BCCA), 2024, and slapping the state government with compensation and litigation costs of Rs.2.20 lakhs. Maintaining that police and district officials acted with "complete ignorance of the law" to allegedly restrict individuals ahead of elections, a division bench comprising Justice RR Prasad and Justice SD Mishra found that the order severely infringed upon fundamental personal liberty. The petitioners Shashi Kumar alias Fulani and Ajay Singh had filed the petition seeking quashing of Nalanda DM's October 10, 2025 order on the plea that they had been falsely implicated in different criminal cases in which they are on bail and ready to face trial. The petitioners had been ordered by the Nalanda district magistrate (DM) to mark their attendance three days a week at Silao police station, located 40 km away, under Section 3 of the BCC Act. The court ordered the state to pay Rs.1,00,000 compensation along with Rs.10,000 litigation costs to each petitioner within one month, recoverable directly from the erring officials. The order was passed on September 11 and uploaded on September 15. "We are constrained to observe that even the SP, Nalanda, the SDPO, Nalanda and the SHO, Giriyak police station, all have acted in haste without verification of the allegations made in the Sanha and they, being police officers, have shown complete ignorance of the law on the subject. We are afraid, such kind of police action, just to stop someone from being a part of the Assembly Election, is not going to help the administration at all and in all probability, it would bring bad repute to the district administration," the court observed....
