Medical negligence: Consumer panel sets Rs.33L payout for hosp
DARBHANGA, June 3 -- The District Consumer Disputes Redressal Commission, Darbhanga, has held the management of Paras Global Hospital, Laheriasarai, guilty of deficiency in service and medical negligence, directing it to pay Rs.33.20 lakh in compensation to the family of a patient who died during treatment in January 2023.
A copy of the order, seen by Hindustan Times, was passed by Commission president Piyush Kamal Dixit and member Arun Kumar Srivastava in consumer complaint case no. DC 195/CC/34/2023.
"The commission found the hospital responsible for the untimely death of 47-yr-old Barun Kumar Jha and awarded compensation under various heads," said Murari Lal Kewat, counsel for the complainants.
According to the order, the complainants are entitled to Rs.28.80 lakh for the loss caused by the death, Rs.2.40 lakh towards future prospects, Rs.1.10 lakh towards medical expenses, Rs.25,000 for loss of estate, Rs.40,000 for loss of consortium, Rs.15,000 towards funeral expenses and Rs.10,000 as litigation costs, taking the total compensation to Rs.33.20 lakh.
In its order dated May 21, 2026, the commission directed the hospital to make the payment within 45 days of receiving the order. In the event of default, the amount will carry interest as stipulated in the order.
According to the complaint, Barun Kumar Jha, a district manager with a pharmaceutical company, was admitted to Paras Global Hospital at Allalpatti on the night of January 6, 2023, after his health deteriorated. Following medical examination on January 7, hospital authorities allegedly informed the family that he was out of danger. However, his condition suddenly worsened later that night and he died around midnight.
The family alleged that when they sought details regarding the cause of death and the treatment administered, the hospital management failed to provide a satisfactory explanation and instead handed over a bill of Rs.1.10 lakh. Repeated requests for the patient's treatment records were also allegedly not complied with.
Paras Global Hospital's (Darbhanga) key official, Manoj Kumar said he was not aware of this matter. The hospital's legal team at Gurgaon corporate office was examining it and a detailed response or feedback would be provided only after their response....
