Khan Sir not to surrender, will seek interim bail in firing case: Lawyer
PATNA, June 7 -- Faisal Khan, popularly known as 'Khan Sir', who has been named in the FIR in connection with firing at his Patna-based coaching institute, will not surrender in the court and will move for anticipatory bail on Monday, his lawyer Arvind Kumar Mauaar said on Saturday.
Khan has been booked Khan under section 109 (attempt to murder) of the BNS and the Arms Act.
Nearly 48 hours after the FIR, the Patna Police failed to arrest him. However, Faisal's lawyer said that the renowned educator was named in the case as part of a conspiracy orchestrated by the director of a rival coaching institute.
Four days ago, Khan claimed that "eight to 10 rounds of gunfire" were fired outside his coaching institute, Khan Global Studies, after a group allegedly vandalised the premises in Patna's Musallahpur area. Later, the police arrested three persons linked to the rival Gyan Bindu Coaching Institute, including its director, Raushan Anand, triggering protests by students and a continued tension in the city.
Khan's lawyer said that the police registered the FIR against Khan, or inserted his name in it, because the rival party lodged a complaint in retaliation. "The FIR lodged against him is in retaliation because his staff had lodged a case against the director of another coaching centre and employees on June 2. The two guards fired in the air for defence; no one was injured in the firing. But Khan's name has been inserted in the disclosure statement in the FIR. This is an attempt to frame and defame him. We will file an anticipatory bail plea on Monday," said Muaar.
The lawyer further claimed that the FIR is incorrect and that no firing took place due to his client. He also denied allegations that Khan made any provocative statement, adding that the police wrongly recorded details in the FIR.
The FIR against Khan was registered based on alleged statements given by his two arrested security guards Pradeep Kumar (from Mainpuri, UP) and Talebar Singh (from Kasganj, UP) who reportedly told police that Khan and some associates asked them to fire at a crowd gathered outside his coaching centre following violence and vandalism on June 2, as per the FIR's content.
Meanwhile, police teams remained deployed near Khan's coaching institute from Friday night until Saturday morning, where a large number of students had also gathered.
According to Shashikant alias Sadhu, an advocate of Patna Civil Court, if it is proven during trial that the bodyguards fired on Khan's instructions, he could be found guilty under section 109 of the BNS and may face up to 10 years in jail....
