PATNA, Sept. 27 -- BJP activist Sheela Pandit registered a complaint against the Patliputra MP and RJD leader Misa Bharti with the Sachivalaya police station on the allegation of publicly posting/distributing the family photo of the minor girl of Jammu in the electronic and social media. In her complaint the BJP leader said that this act is a cognisable offence under Section 23 of the POCSO Act, 2012 and Section 74 of the Juvenile Justice Act. Under these provisions, there are legal restrictions on disclosing the identity of any victim child or their family (such as name, address, photograph, etc.). Taking cognizance of this matter, an FIR should be registered immediately under appropriate sections. BJP leader also requested for impartial and prompt investigation in accordance with the law in this matter. The safety and privacy of the victim girl and her family must be maintained. "A video/footage of the photograph being released to the media is attached to the pen drive. Given the sensitivity of the matter, it has been requested to maintain the privacy of the video and photographs," said Sheela Pandit, BJP spokesperson. Earlier on Friday, RJD MP Misha Bharti also arrived at the Sachivalaya Police Station to file an FIR against chief minister under sections 23 of the POCSO Act, 2012 and 74 of the Juvenile Justice Act, 2015, regarding the disclosure of the identity of the Jamui minor girl and her family members in a social media handle of chief minister Samrat Choudhary. Meanwhile, the RJD called the complaint put by the BJP functionary as totally baseless and a ploy to divert attention from the way CM's office had disclosed the identity of the minor girl victim of Jamui molestation case. Ejaz Ahmad , party spokesperson and leader, said the RJD's Patliputra MP Bharti had herself gone to Sachiwalaya police station on Friday to lodge a FIR against CM Choudhary and others for disclosure of the Jamui victim's identity.
