PAtna, Aug. 6 -- The Raj Bhawan on Wednesday nominated Deepak Prakash, state panchayati raj minister and a Rashtriya Lok Morcha (RLM) leader, as new member of the legislative council under the Governor's quota. A senior officer of Raj Bhawan confirmed the decision. The vacancy arose after the resignation of BJP member Devesh Kumar. Prakash is expected to be sworn in as an MLC on Thursday. Earlier, the state cabinet, chaired by CM Samrat Choudhary, on Wednesday approved Prakash's name and forwarded the proposal to Raj Bhawan for the assent of Governor Syed Ata Hasnain, officials said. Prakash was sworn in as a minister in the Samrat Choudhary cabinet on March 12 this year. However, he had not yet become a member of either house of the legislature. The Supreme Court recently served notices to the Bihar government and the minister, seeking an explanation as to why Prakash continued to hold the ministerial post without being a legislator, in light of constitutional provisions that require a minister to become a member of the legislature within six months of assuming office.
