Cop sends legal notice to RJD MP over 'encounter' allegation
PATNA, Oct. 16 -- Buxar Lok Sabha MP Sudhakar Singh on Thursday took serious exception to the legal notice served to him on behalf of senior IPS officer Kundan Krishnan, warning him to retract his "defamatory statements alleging misuse of the official position by the officer".
"I have received a legal notice because I raised questions in the public interest regarding the suspicious death of Bharat Bhushan Tiwari in Bilaoti village, Bhojpur district, and the Jamui incident. I want to make it clear that neither my voice can be silenced by the threat of a legal notice, nor can the public's questions be evaded. Portraying the murder of Bharat Bhushan Tiwari as merely a 'police operation' and presenting the case as routine action is shameful in itself," said Singh.
The MP said that he has instructed his advocates to provide a lawful response to the legal notice. "The fight for justice will continue and accountability will be established. The voice of the people will not be silenced," he added.
Apurv Harsh, Advocate (Partner, Niti Law Associates) issued the legal notice under instructions and on behalf of client Kundan Krishnan, IPS "for taking down the defamatory statements and imputations made against the officer to tarnish his image."
"Within 15 days of receipt of this notice, issue a clear, unconditional and public apology, failing which my client shall initiate appropriate legal proceedings against you, including a Civil Suit for defamation seeking damages of Rs.5 crore and criminal prosecution for defamatory conduct under the Bharatiya Nyaya Sanhita," says the notice.
The officer refused to comment on the matter.
Reiterating his demand, Singh said in a democratic system a death cannot be dismissed as a standard police operation without answering the basic question as to what were the circumstances leading to loss of life and who ordered action.
"I stand by my questions even today. In this case, the involved police personnel were suspended, an FIR was registered on the complaint of the deceased's mother, and the government ordered a judicial inquiry. My clear demand is that the accountability in this case should not be limited only to lower-level police personnel; there must also be an impartial investigation into the role of the top officials who were making decisions and leading the entire system at that time," the MP said.
He said that Kundan Krishnan was serving as the DG of Bihar STF when the encounter took place and hence he was answerable. "I have also raised questions in public interest regarding the Jamui incident. I will neither apologise nor back down. My demand for fair, independent, and time-bound investigation into the death of Bhushan Tiwari and the role of senior police officials remains," he added....
