Civil court employees to mark Black Day on Oct 7, warn of indefinite stir
BUXAR/ARA, Oct. 5 -- The Bihar State Civil Court Employees Association announced on Sunday that it would observe "Black Day" on October 7 to highlight their long-pending service-related issues of civil court staff. It also wrote to the Chief Justice of Patna High Court that if their demands are not heeded, the association will usher in an indefinite strike from November 2.
Association president Rajeshwar Tiwary said the decision to mark "Black Day" and indefinite strike was taken during a meeting at the dharna site in Patna on August 9 and that the association will proceed with its demands in a peaceful and phased manner.
As part of its "Black Day" observance on October 7, the employees of all civil courts in Bihar will wear black bands/black ribbons, discharge regular judicial and office duties, maintain the dignity and discipline of the courts, respect the interests of the public and litigants, and not disrupt court work. The programme is intended solely as a peaceful democratic expression to draw the attention of competent authorities to pending problems, a letter written to the CJ by the association stated.
If October 7 observance doesn't lead to concrete actions towards resolution of their demands, it would be followed by indefinite strike (leave) from November 2, the letter reads. The leaves will not end until their demands are not met, the letter states.
The association clarified that such a step is not its preference and that employees want judicial work to continue smoothly without inconvenience to the public or litigants.
The major demands listed by the association include effective and time-bound implementation of the Supreme Court judgment in Civil Writ Petition No. 1022/1989 and related recommendations of the Patna High Court Standing Committee; cadre restructuring of court assistants/employees and pay revision from January 1, 2006; early disposal of pending promotions; review of over-dependence on MACP; clear delineation of duties according to rank; time-bound compassionate appointments for eligible dependents; transparent posting and transfer within home district/division; creation of a special judicial employee cadre suited to court functioning; revision of allowances and facilities in the light of the Shetty Commission and judicial orders.
It also includes prevention of unfair or discriminatory treatment and impartial redressal of grievances; health cards/adequate medical facilities for employees and their families; education allowance for children; and a decision on the OPS for judicial employees....
