Male nurse gets 5-yr jail term for molesting patient in ICU
MUMBAI, Oct. 23 -- A male nurse who molested a female patient while she was undergoing treatment for acute abdominal pain in the intensive care unit (ICU) of Joy Hospital in Chembur has been sentenced to five years of rigorous imprisonment.
Additional Sessions Judge VB Bohra convicted Sanjay Mahesh Yadav of sexual harassment and assault with intent to disrobe, ruling that he exploited the victim's vulnerable condition and severely abused the trust reposed in healthcare professionals.
The prosecution established that the woman was readmitted to the ICU after experiencing severe pain and vomiting. Around 1:30 am, following a doctor's visit, she became drowsy. She awoke to find Yadav touching her breast and body with her T-shirt pulled up. Yadav claimed he was preparing her for an electrocardiogram (ECG) and gave her a tablet, after which she lost consciousness again. He then removed her T-shirt and continued the assault. The next morning, the patient reported the incident to treating doctors, who confirmed that no ECG or medication was documented at that time. Reviewing the ICU CCTV footage from between 3:30 am and 3:50 am, hospital staff verified the molestation and alerted Chembur police.
The court found the victim's testimony credible, consistent, and strongly corroborated by medical staff, a friend who waited overnight, and unedited CCTV footage. Rejecting Yadav's claims of fabricated evidence and his plea for leniency based on family hardship, Judge Bohra emphasised the gravity of abusing a medical position to target a helpless patient. Yadav was handed concurrent sentences of three and five years, alongside fines, with Rs.20,000 awarded to the victim as compensation....
