SC junks Reliance plea, imposes Rs.10L cost
Bengaluru, Aug. 15 -- The Supreme Court on Friday dismissed Reliance Industries Ltd's (RIL's ) challenge against a Bombay high court order directing the company to redact portions of its witness affidavits in its dispute with NTPC Ltd over a proposed 17-year supply of natural gas.
The Court also imposed a cost of Rs.10 lakh on RIL and directed it to pay the amount to the Supreme Court Advocates-on-Record Association within five weeks.
A bench of justices PS Narasimha and Alok Aradhe dismissed RIL's challenge to the August 22, 2024 order of the Bombay high court that had permitted redacting of portions referencing internal communications while retaining portions reflecting its witness's genuine perceptions or the actual correspondence exchanged between the parties.
It had held at the time that Reliance's witness BK Ganguly could place it on record through his affidavits of examination-in-chief.
The top court in its present judgement said there was no error in the high court's order. "The power of the RIL to litigate and obstruct progress of the suit seems unlimited," SC said, adding, the company faced "no shortage of financial resources and no obligation to help courts cope with pending backlogs."
It noted that RIL appeared to find it "lucrative" to raise objections at every stage, and when trial courts rejected them, to pursue appellate and special leave remedies instead....
