OBA polls: HC seeks clarity on CoP reissue
LUCKNOW, Oct. 22 -- The Lucknow bench of the Allahabad high court has sought clarification from the Bar Council of Uttar Pradesh on whether an advocate's Certificate of Practice (CoP) can be reissued to reflect a change in the place of practice.
A division bench of Justices Rajan Roy and Manjive Shukla, in its October 14 order, asked whether reissuance of a CoP is permissible and, if so, whether any time limit is prescribed for it.
The bench sought the clarification while hearing a public interest litigation (PIL) filed by advocate Girdhari Lal Yadav concerning the upcoming Oudh Bar Association (OBA) election.
The court also sought clarification on whether an advocate can change the Bar Association where they exercise voting rights, as mentioned in the CoP, and, if so, within what time limit such a change is permitted. The bench directed the Bar Council's counsel to obtain instructions on the applicable rules and any prescribed time limits. Meanwhile, the court asked the counsel to furnish details, as reflected on the Bar Council's website, of voters whose names appear on the list finalised by the returning officer (RO) for the ensuing OBA election. The order records that the RO had finalised a list of 5,108 members eligible to vote.
To facilitate the exercise, the court directed the RO to provide the Bar Council's counsel with a copy of the list containing the names of all 5,108 voters.htc...
