No order on plea to replace cloth on wazukhana lock
varanasi, Dec. 16 -- The court of Varanasi district judge Sanjeev Shukla on Monday did not pass an order on a plea seeking to replace the cloth on the sealed lock of the wazukhana (ablution area) of the Gyanvapi mosque complex here.
Mumtaz Ahmad, counsel for the Anjuman Intezamia Masajid Committee (AIMC), said the court observed that since the matter is under consideration before the Supreme Court, the district court does not have the jurisdiction to pass any order on the issue.
The court made this observation in light of the Supreme Court order that no new case should be admitted nor order passed by subordinate courts as long as the matter is under consideration before it (SC) as that could affect the proceedings in the apex court, Ahmad said,
The wuzukhana area of the Gyanvapi mosque was sealed on May 16-17, 2022, following a court-ordered survey conducted by the Varanasi civil judge (senior division) in accordance with a Supreme Court order.
On August 8, the special counsel appointed by the state government, Rajesh Mishra, filed a plea in the district court seeking an order to replace the cloth on the lock due to wear and tear.
Opposing the plea, Akhlaque Ahmed, counsel for AIMC that looks after the management of the Gyanvapi mosque, reiterated his argument that the wazukhana was sealed by an order of the Supreme Court and, therefore, only the apex court could pass directions on the matter. He also presented a copy of the order passed in the writ petition (civil) Ashwini Kumar Upadhyaya Versus Union of India and others before the court.
After hearing all the parties in the matter, the court on December 3 had fixed December 15 as the date for the order....
