LUCKNOW, Sept. 5 -- The Lucknow bench of the Allahabad high court on Thursday permitted continuance of the ongoing counselling process for admission in four state-run medical colleges in Ambedkar Nagar, Kannauj, Jalaun and Saharanpur in the present session as a one-time measure. However, the high court put on hold the single-judge bench's order for fresh counselling in these four government medical colleges. In its interim order, the high court directed the state government to file its undertaking within a week that the state will comply with provisions of the Reservation Act, 2006, for fixing the quota in medical seats. A division bench of Justice Rajan Roy and Justice Manjive Shukla passed the order on the Uttar Pradesh government's special appeal challenging a single-judge decision that struck down six government orders (GOs) issued between 2010 and 2015. These GOs had introduced reservation in admissions to four state-run medical colleges in Ambedkar Nagar, Kannauj, Jalaun and Saharanpur, resulting in 79% seats being reserved. The court had reserved its order on September 2. The court ordered that Scheduled Caste (SC) students admitted to the four government medical colleges in excess of the quota must be moved to other government medical colleges. This adjustment will happen without affecting the rights of higher-merit SC candidates. Students with lower merit will be moved first, and their fees will be adjusted accordingly. Any seats that become vacant in these four colleges will be offered in the next round of counseling to OBC and unreserved category candidates, it said. The court made a special provision for the petitioner. If she agrees in writing, she will be given a seat at the medical college in Ambedkar Nagar. The high court also said it has made its decision based on an assurance from the state government that for the next academic year (2026-2027), the four medical colleges will strictly follow the 21% reservation limit for Scheduled Castes as set by the 2006 Act. "... a written undertaking in this regard in the form of an affidavit shall be filed by the appellants within one week from today, failing which this order shall cease to operate," the high court ordered. It directed to list this case in the second week of October when the appellants shall file an affidavit.
