HC seeks Centre, ASI's reply on plea for advocate commission
PRAYAGRAJ, July 7 -- The Allahabad high court on Monday asked the Centre and the Archaeological Survey of India (ASI) to file their counter affidavits on a writ petition that sought the issuing of an advocate commission to survey the Taj Mahal in Agra and examine a claim that a Shiva temple originally existed on the monument's premises.
The petition was filed on June 30 after the civil judge (senior division ) as well as the additional district judge at the district court in Agra declined to pass an order for appointing such a commission.
Advocate Hari Shanker Jain submitted before the court that the application for issuing an advocate commission as well as for photography of premises in dispute has wrongly been rejected by trial court and thereafter the revision has been dismissed as not maintainable. Though the same was necessary for adjudication of the dispute.
Justice Rohit Ranjan Agarwal directed the Centre and the ASI to file counter affidavits in the matter and also issued notice to one Pankaj Kumar Verma who is respondent No. 4 in the writ petition. A declaratory suit filed in the district court in 2015 sought a declaration that the temple of Lord Sri Agreshwar Mahadev Nagnatheswar Virajman (Tejo Mahalaya) originally existed on the Taj Mahal premises, according to the petitioner's counsel.
