HC orders statewide survey of all parks, playgrounds, open spaces
LUCKNOW, March 2 -- In view of the environmental protection, the Lucknow bench of the Allahabad high court has directed the divisional commissioners of all 18 divisions and the district magistrates of all UP districts to conduct an exercise to include all parks, playgrounds and open spaces in the prescribed list throughout the state.
The court also directed the state government to ensure that such an exercise takes place as ordered.
"Let the Local Body/Prescribed Authorities conduct a survey of all parks, playgrounds and open spaces within the municipal limits of Lucknow which are liable to be included in the list referred in Section 3 of the Act, 1975 read with corresponding Rules, 2005," the court directed.
A division bench of Justice Rajan Roy and Justice Abdhesh Kumar Chaudhary passed the order on February 24 on a PIL petition filed by one Dharampal Yadav.
The petitioner sought directives for inclusion of the Janeshwar Mishra Park, Lucknow in the list of parks referred in UP Parks, Playgrounds and Open Spaces (Preservation and Regulation) Act, 1975 in view of the environmental protection. "We are surprised at its non inclusion in the said list.", the court said while listing the case for next hearing on April 10.
