PRAYAGRAJ, Aug. 5 -- The Allahabad High Court dismissed a petition filed by The Cricket Association of Uttar Pradesh seeking the transfer of all the assets, accounts and resources belonging to the dissolved The Uttar Pradesh Cricket Association. The bench comprising Justice Atul Sreedharan and Justice Siddhartha Nandan dismissed the petition as baseless. The court observed that the Cricket Association of Uttar Pradesh, by presenting itself as the state's official or recognised cricket body, was misleading and fraudulent. It said the use of a similar name appeared to be an attempt to create confusion among the public, players, district cricket associations and other stakeholders. In its August 3 judgment, the court said, "The Uttar Pradesh Cricket Association (UPCA) is the only body affiliated with and authorised by the Board of Control for Cricket in India (BCCI). The court clarified that the erstwhile The Uttar Pradesh Cricket Association was lawfully dissolved in 2005 in accordance with statutory rules, and transferring of its assets, liabilities, functions and accounts to the Uttar Pradesh Cricket Association (a company registered under Section 25 of the Companies Act, 1956) was legally valid. The court said the state government's permission was not required for the process, as it had failed to establish any financial contribution to or legal interest in the erstwhile society. The demand to transfer UPCA's assets, accounts, and resources to the petitioner organisation (CAUP) was therefore rejected. The demand for an investigation against UPCA by the CBI or any other central agency was also rejected. The court rejected the petitioner's demand to transfer UPCA's assets, accounts and resources to the Cricket Association of Uttar Pradesh (CAUP).
