HC allows revisionist's hearing in plea to enhance sentence
PRAYAGRAJ, April 16 -- The Allahabad high court has directed the special judge (MP/MLA), Rampur, to hear Nawab Kazim Ali Khan in the appeal filed by the state government seeking enhancement of the sentence awarded to Azam Khan in its November 17, 2025 conviction order.
Justice Vikram D Chauhan passed the order while disposing of a petition filed by Nawab Kazim Ali Khan alias Naved Miyan, who had challenged the order of the special judge (MP/MLA)/additional sessions judge (Court No. 2), Rampur. His revision plea seeking enhancement of Azam Khan's sentence had been dismissed on the ground that the state government had already filed an appeal for enhancement, making the complainant's revision not maintainable. During the hearing, counsel for both sides agreed that the revisionist-complainant be permitted to participate in the state's appeal before the sessions court and be heard in the matter.
Disposing of the petition by its order dated April 10, the court observed: "In view of the agreement entered between the parties, the present application under Section 528 BNSS is disposed of with a direction to the Court of Special Judge (MP/MLA)/Additional Sessions Judge, Court No. 2, Rampur to hear the present revisionist-Nawab Kazim Ali Khan Urf Naved Miyan in the appeal filed by the State against the order of conviction dated 17.11.2025 passed in Criminal Case No. 311 of 2022 and Complaint Case No. 1419 of 2018."...
