3-month jail for Rajpal in cheque bounce cases
New Delhi, July 11 -- The Delhi high court on Friday sentenced Bollywood actor Rajpal Yadav to three months' imprisonment in seven cheque bounce cases after upholding his conviction by the trial court, even as it suspended the jail term for two months to enable him to file an appeal.
A bench of justice Swarana Kanta Sharma also directed Yadav to pay Rs.1.05 crore in each case as compensation to the complainant, M/s Murli Projects Private Limited, as well as Rs.25,000 to the State.
The court further noted that Yadav had challenged the trial court's 2019 judgment convicting him in the case only after an extraordinary delay of five years, the challenge to the conviction was barred by limitation, since he had failed to show "sufficient cause" for condoning the delay.
In its 108-page order, the court refused to grant Yadav the relief of probation, noting that the actor had repeatedly failed to honour undertakings given before the court to repay the complainant. It said that though the predecessor bench had initially been disinclined to hear the matter on merits, it suspended his sentence after he expressed willingness to amicably resolve the dispute.
It noted that over the following months, the court granted him several opportunities to settle the matter, while Yadav and his senior counsel repeatedly assured the court that payment would be made and sought adjournments to arrange funds but despite these assurances, he failed to fulfil his commitments, prompting the court to direct him to surrender.
Although some payments were later made and his sentence was suspended for a third time to facilitate a settlement, no final resolution was reached and even before judgment was reserved, Yadav stated in open court that he would rather "go to jail five more times" than repay the complainant, the court said.
Yadav and his wife Radha were convicted by the trial court in April 2018.
Messrs Murli Projects Private Limited had filed a criminal complaint against Yadav, alleging that he had taken a loan of Rs.5 crore in 2010 for the production of the film "Ata Pata Lapata", with a commitment to repay Rs.8 crore. However, he allegedly failed to honour this commitment....
