quasi-judicial authorities, including CS, should undergo training: HC
Shimla, April 30 -- Himachal Pradesh high court (HC) on Wednesday directed the state government to ensure all quasi judicial authorities, including the chief secretary (CS), "to undergo training in HP judicial academy".
The directions were passed by the HC while setting aside an order passed by the chief secretary in a town planning dispute, holding that the principle of natural justice was violated as the same authority adjudicated both the appeal and the revision in the matter.
The state has been asked to work out the training framework within four weeks and submit a compliance report by May 28.
Allowing a writ petition filed by one Bishwa Nath Sharma, justice Jyotsna Rewal Dua ruled that no person can act as a judge in their own cause, invoking the well-established legal maxim "nemo judex in causa sua."
Disposing off the petition, high court bench of justice Jyotsna Rewal Dua on April 20, copy of which was made available on Wednesday, directed state government to "to formulate in collaboration with the Himachal Pradesh Judicial Academy, a comprehensive training program at HP Judicial Academy, Shimla, wherein focus shall be to equip the concerned officers/Quasi-Judicial Authorities with better knowledge of law governing their fields, especially the principles of natural justice".htc...
