Shimla, Aug. 15 -- During the resumed hearing of the election petition filed by Congress leader Abhishek Manu Singhvi, Himachal Pradesh high court on Thursday clarified that no unnecessary adjournments will be given and fixed strict timeline to commence the evidence stage in the election plea. The plea, filed by Singhvi, challenged the interpretation of draw of lots rules by the election officer after there was a tie in the Rajya Sabha polls. BJP nominee Harsh Mahajan had won the February 27 election through draw of lots after both candidates secured 34 votes each. The returning officer declared Mahajan elected after a draw of lots, a process Singhvi has challenged, alleging incorrect application of statutory provisions. Justice Bipin Chandra Negi noted that the admission and denial of documents between the parties remains incomplete and directed that the process be concluded by on August 26, with no unnecessary adjournments. Within 15 days thereafter, the respondent's counsel must submit a list of witnesses along with the requisite processfee and diet money, the order said. The high court directed that the matter will then be placed before the Additional Registrar (Judicial) on September 12 to fix dates for recording the evidence of the respondent's witnesses.
