Jaipur, July 23 -- The Supreme Court on Wednesday modified its interim order on the retirement age of district-level judicial officers, clearing the way for judicial officers in Rajasthan to retire at the existing age of 60 years while seeking the stand of all state governments and high courts on whether the retirement age should be enhanced to 61 years across the country. A three-judge Bench headed by the Chief Justice of India, hearing the All India Judges Association matter, clarified that the benefit of continuation in service beyond the existing age of superannuation would be available only in states where both the state government and the high court have recommended enhancement of the retirement age. In the absence of such consensus, judicial officers will retire upon attaining the existing retirement age. During the hearing, Additional Advocate General Shiv Mangal Sharma said the Rajasthan government informed the apex court that the retirement age for both state government employees and district-level judicial officers in the state remains 60 years and that it has not recommended any increase. The court also noted that several other states opposed a blanket enhancement of retirement age. The Bench examined the position in Madhya Pradesh and Telangana, where the issue of increasing the retirement age had arisen in separate proceedings with recommendations from the respective state governments. It observed that the developments in Madhya Pradesh were on a different footing and should not automatically apply to other states.
